I had a wrist injury at work and work doctor said I have a preexisting condition. Can I open a comp case?

Work doctor says I have madelungs deformity. It has been a month and my condition has worsened. Work doctor sent me back to work with no use of my right hand. My employer sent me home after 3 hours and told me not to come back till I see the surgeon in 2 weeks. I am being forced to use my sick time. Employer is paying all medical out of pocket. Is this legal?
