If spill/accident at work Manager Takes you to have drug test, then takes you home w/out getting your vehicle?

by admin on September 9, 2010

the company has just put a practice in place to where if you have a spill with the product the company will have a manager take you to have a drug test taken. After the Drug Test you will be driven home by the manager (They WILL NOT bring you back to your vehicle at the workplace.) And you are not allowed to return to the workplace until the drug test has cleared. Is this not putting risk on the manager as well as not only keeping the person out of work until the drug test has cleared but also leaving the worker w/out transportation??
wouldn’t they have to give the employees written documentation on the changes of the policy??

They probably do that to protect the employee. If there is any possibility that the employee is impared, taking him home is for his own safety. He can always get a ride to the workplace parking lot and retrieve the vehicle. I doubt they would prevent his access to the parking lot.

It may be a big inconvenience, but you can always choose not to spill or to work somewhere else.

Management can pretty much set any rules they want on conditions of employment, but I don’t think they can place a rule into effect that essentially takes property from you without a hearing.

If you are in a union, speak to your representative. If not try discussing your concern with management. If there are others, and you can go as a group it might have more weight.

If they won’t budge, you might consider an attorney, or a new job that is less restrictive.

By not allowing you to return to the workplace they probably mean the building. If you show up to retrieve your car then how will they stop you? If they fire you for it then consider yourself better off. If they tried to call you out for trespassing then call them out for theft.
