Is it against the law to NOT report a workplace accident to the Bureau of Workers Compensation?

by admin on August 14, 2011

I had a small accident at work and my boss wanted me to just give her hospital receipts and reimburse me for my emergency room visit and antibiotics instead of reporting it to the BWC. Is it against the law to not report it?

Not sure about that. There are OSHA recordable accidents and Worker’s Compensation which are two separate things but both are covered by laws concerning accidents in the workplace. Worker’s comp usually involves what is called a lost time accident. It also can make a difference if a prescription was involved. It depends on the laws within your state.

Accidents that result in a death or hospitalization must be reported. There is a lot of leeway as to reporting when the accidents are minor and do not require extensive medical care
